Developer appealing permit requirement for data center project in Chesterfield

A developer in Chesterfield, Virginia is appealing a county planning department ruling that a proposed data center project requires a conditional-use permit to proceed. The developer claims the project should be grandfathered under the previous zoning ordinance which allowed data centers as a by-right use in the industrial zoning district. The matter will be heard by the Chesterfield Board of Zoning Appeals in May.
