Chesterfield Board to Hear Appeal Over Data Center Permit Requirement

Reston-based WestDulles Properties is seeking to overturn Chesterfield County staff’s determination that a conditional-use permit is required before construction can begin on data centers planned at 1120 Battery Brook Parkway near Chester. The developer argues it has a vested right to build the project by right under the county’s previous zoning ordinance.

The Chesterfield Board of Zoning Appeals is scheduled to hear the appeal, and county staff recommends denial. A new zoning ordinance that took effect this year requires conditional-use approval for data center projects; the board earlier rejected a similar appeal involving another Chester data center development.
