The Chesterfield County Board of Zoning Appeals rejected WestDulles Properties’ appeal concerning plans to build a data center near 1500 Battery Brook Parkway in the James River Industrial Center. The developer argued that its plans were filed before a new ordinance requiring conditional-use approval, and may pursue legal action.

Gov: Chesterfield County Board of Zoning Appeals, Chesterfield County

The Chesterfield County Board of Zoning Appeals denied an appeal by Reston-based WestDulles Properties over its proposed data center near 1500 Battery Brook Parkway in the James River Industrial Center. WestDulles argued that it had vested development rights because its plans were submitted before Chesterfield adopted an ordinance requiring future data centers to receive conditional-use approval.

County officials rejected the claim, leaving the land-use dispute unresolved. WestDulles may seek legal action, while the new ordinance remains applicable to future data center projects in the county.
