Hayward Approves 45-Day Moratorium on New Data Centers
Hayward City Council unanimously approved a 45-day moratorium on new data centers to study their effects on electricity and water use, noise, air quality and the community. The pause follows public backlash and could be extended for up to a year while city staff develops a regulatory framework.
Hayward’s City Council approved an urgency ordinance imposing a 45-day moratorium on new data centers. City staff will use the pause to assess potential impacts on utility rates, electricity and water consumption, noise, air quality, the environment and local employment. The council is scheduled to consider extending the moratorium on Dec. 1, potentially continuing it for up to a year.
The action followed public criticism of a hyperscale data center approved by the Hayward Planning Commission in May 2025, as well as the presence of three operating facilities and a fourth under construction. The council had already adopted stricter permitting requirements, including council and Planning Commission approval, a new land-use designation and sustainability reports. Mayor Pro Tem George Syrop said the moratorium would give the city time to respond to community concerns and avoid further risks to Hayward’s water, electricity and environment.
