The NAACP has launched a lawsuit against Elon Musk's artificial intelligence company, xAI, accusing it of violating the Clean Air Act in Memphis, Tennessee. The suit alleges that xAI operates over two dozen methane gas-burning turbines without proper legal permits to power its Colossus 1 and Colossus 2 data centers. These operations are reportedly emitting toxic pollutants into predominantly Black neighborhoods, causing significant environmental harm.
KeShaun Pearson, executive director of Memphis Community Against Pollution (MCAP), stated that pollution from xAI's energy generation exceeds that of the Memphis International Airport. Pearson emphasized that children in the region already face the highest rates of emergency room visits for respiratory issues in Tennessee, a situation she fears will worsen. She described Memphis as a "cautionary tale" regarding the absence of adequate regulations for such projects. The lawsuit also highlights that xAI has failed to deliver on initial job creation promises.
Musk reportedly chose Memphis due to the availability of an abandoned Electrolux factory, aiming to expedite AI applications. However, critics, including Pearson, argue that the area, particularly southwest Memphis, has historically been targeted for environmentally unjust projects, echoing concerns about environmental racism. MCAP, alongside the NAACP, the Southern Environmental Law Center, and Earthjustice, is demanding a moratorium on data center construction in the city.
