Vineland DataOne Data Center Fined $1 Million Over Generators
The New Jersey Department of Environmental Protection has fined the DataOne data center in Vineland $1.07 million for installing and operating 62 large natural gas generators without required state permits. This action marks the largest enforcement fine against a data center in New Jersey's history for violating the Air Pollution Control Act. DataOne plans to apply for permits but disputes the characterization of the generators as temporary, stating a transition to fuel cells is underway.
The New Jersey Department of Environmental Protection (NJDEP) has issued a record $1.07 million fine against DataOne's data center in Vineland, Cumberland County. This penalty, which is the largest enforcement action taken by the state against a data center, was levied because DataOne installed and operated 62 large natural gas generators without the required state permits, violating the New Jersey Air Pollution Control Act.
NJDEP inspectors discovered the unauthorized generators, each with a capacity exceeding the 37-kilowatt permitting threshold by more than 50 times, during a July 29 visit. Commissioner Ed Potosnak underscored the state's resolve to hold data centers accountable, emphasizing that the permit process is crucial for reviewing equipment and its associated emissions, including carbon dioxide, nitrogen oxides, and carbon monoxide.
The DEP has mandated that DataOne either obtain the necessary permits or cease operating the generators. While a DataOne spokesperson confirmed the company's intention to apply for the permits, they also expressed disagreement with the state's determination that the generators are "temporary." DataOne stated that it is transitioning to low-emission fuel cells for its permanent power solution and is engaging in discussions with the NJDEP regarding its findings and the timeline for this transition.
