The Trump administration has formally intervened in a federal lawsuit, seeking to dismiss a case filed against Elon Musk's xAI and its subsidiary MZX Tech over alleged environmental violations at its Colossus data center in Southaven, Mississippi. The lawsuit, initiated by the NAACP and environmental groups like Earthjustice, accuses xAI of operating up to 57 natural gas turbines without the necessary permits, thereby violating the Clean Air Act through the emission of harmful pollutants such as nitrogen oxides, particulate matter, and formaldehyde. These emissions are a concern for nearby communities already facing high pollution levels.

The Justice Department's filing argues that Mississippi regulators had already determined no federal permit was required for the turbines and asserts that the AI facility supports "national, economic and energy security," including applications for Department of War operations and advanced AI systems like Grok. The USD 20 billion data center is situated close to homes, schools, and churches in North Mississippi and the Memphis region.

Environmental groups have voiced strong opposition to the administration's intervention, viewing it as an attempt to protect a powerful tech company from accountability and undermine public health safeguards.
