Texas data center boom raises transparency concerns

Texas is experiencing a significant boom in data center development, driven by factors such as land availability, low regulation, and business-friendly tax incentives, including a sales tax incentive. However, this growth has raised significant transparency concerns among residents and some local officials across the state. An in-depth report by the Texas Tribune highlights that information regarding these massive projects is often difficult to access, with details frequently surfacing only after plans are well underway.

Residents and officials from both rural and urban areas are particularly concerned about the environmental impact, specifically the strain on water and power resources in drought-prone regions, and the potential for rising electric bills. A key issue contributing to the lack of transparency is that while cities possess zoning authority, counties in Texas do not, leading to a significant information gap for county officials and their constituents.

The fragmented nature of information further complicates matters; there is no central state repository for data on water or power usage related to data centers. Developers often use shell companies or their own names in public filings during the early stages of site exploration, making it challenging for the public to identify the actual data center operator. Developers maintain this is a common practice within the industry, claiming they strive for transparency once plans are solidified.

Amid these growing concerns, Governor Greg Abbott has called for an audit into data center operations. This action follows the failure of a large majority of data center companies (less than 10%) to voluntarily provide requested information to state agencies. This audit marks a significant step by state leaders to potentially increase transparency and establish new rules for data center development in Texas.
