Developer sues Cave City over data center zoning moratorium

Kentucky Industrial Alliance LLC has filed a lawsuit against Cave City, Kentucky, challenging a 12-month moratorium on data centers. The developer claims the moratorium is unlawful and that its proposed data center project should be reviewed under prior zoning regulations. Cave City has hired outside legal counsel to handle the case, with the first hearing scheduled for July 20, 2026.

Kentucky Industrial Alliance LLC has initiated legal action against Cave City, Kentucky, and its planning commission, alleging that a recently enacted 12-month moratorium on data centers is unlawful. The lawsuit, filed on June 8, seeks a judicial declaration that the moratorium should not apply to the company's proposed 380-acre data center project on Doyle Avenue.

The developer had submitted its project proposal on May 11, prior to Cave City's decision to implement the moratorium following special council meetings on May 18 and May 20. Kentucky Industrial Alliance claims it has already invested millions into the project and incurred $2,655 in associated fees, asserting that its application should be processed under the zoning regulations effective on May 11.

In response to the lawsuit, the Cave City Council voted on Monday evening to secure outside legal counsel to defend its position. The first court hearing for the case has been scheduled for July 20, 2026, at the Barren District Courthouse.
