Deep Green, a Massachusetts-based developer, has seen its proposal for an underwater AI data center off Eastport, Maine, advance, clearing a significant regulatory hurdle.

The Federal Energy Regulatory Commission (FERC) this week accepted Deep Green's preliminary permit application. This acceptance follows an earlier denial by FERC, which cited multiple deficiencies in the initial application, including the failure to identify local tribes who might be affected by the project and the absence of certain dimensions and map specifications. The company subsequently resubmitted the application with the required changes.

While the acceptance of the preliminary permit allows Deep Green to begin engineering and environmental studies, it does not grant permission for construction. The public now has the opportunity to submit comments to the Commission, file an intervention, or even propose a competing application.
