The legal dispute regarding the construction of a new AI data center in Birmingham's Oxmoor Valley neighborhood has returned to court. The case, which seeks to halt the project, is now under the supervision of a new Jefferson County judge. The judge is prioritizing the resolution of threshold issues before scheduling a preliminary injunction hearing, which could take place next week.
This development follows a previous court session where the case was temporarily suspended after three days of testimony. The former judge, Tamara Johnson, recused herself from the proceedings. Attorneys representing Nebulous had requested her recusal due to Judge Johnson's past professional association with the plaintiffs' attorney.
The lawsuit was filed by Oxmoor Valley residents Robert Sansom and John Benjamin Hickey against Hawk Construction, Nebulous, and the City.
