Olyphant canceled a special meeting that was scheduled to consider settling ERCOR Triboro LLC's lawsuit over plans for seven data centers and a substation. The meeting was postponed after an adjacent property owner announced plans to seek emergency court intervention, while local opponents objected to the proposed $101 million community benefits agreement.

Olyphant Borough Council canceled a special meeting on a proposed settlement with ERCOR Triboro LLC after learning that an adjacent property owner planned to file an emergency court petition seeking to intervene in the litigation. The settlement would have allowed the developer to pursue seven data centers and a substation across nearly 471 acres while providing the borough with a 15-year, $101 million community benefits agreement.

ERCOR sued Olyphant in June, asking a court to compel the borough and its zoning officer to issue a permit after the council adopted zoning rules conditionally allowing data centers in the area. The proposed settlement included borough restrictions on data centers and funding intended to reduce residents' school property taxes and electricity bills, but it drew immediate opposition from local residents and data center opponents. No emergency petition had been filed in the case as of Tuesday night.
