A legal settlement requires the Wisconsin Department of Natural Resources to conduct a comprehensive statewide environmental review of data center development. The settlement resolved a lawsuit brought by Midwest Environmental Advocates and the Sierra Club over permits for Vantage’s data center campus in Port Washington, and requires Vantage to pay for the review.

A settlement between the Wisconsin Department of Natural Resources and environmental advocates will require a statewide review of the environmental effects of data center development. The agreement resolved a lawsuit by Midwest Environmental Advocates, on behalf of the Sierra Club, challenging permits issued to Vantage for its Port Washington data center without a full Environmental Impact Statement.

The DNR must complete the strategic analysis by January 2028 and examine cumulative impacts involving water and energy use, air quality, climate, power plants and transmission lines. The process will include public participation, while Vantage will cover the costs. The settlement also requires project-by-project compliance with Wisconsin’s environmental policy law going forward. State data from the Public Service Commission indicates that the Port Washington project and two others could contribute to a projected 40% increase in statewide electricity demand over six years.
