Texas Governor Orders Pause on Data Center Permits Pending ERCOT Audit
Texas Governor Greg Abbott has ordered the Texas Commission on Environmental Quality (TCEQ) to pause all data center permits until the Electric Reliability Council of Texas (ERCOT) completes a comprehensive audit. This audit, also involving the Public Utility Commission of Texas (PUC) and the Texas Water Development Board (TWDB), will assess data centers' impact on the state's power grid and water resources. The governor also indicated future legislative action to eliminate financial incentives for data centers.
Texas Governor Greg Abbott has issued a directive to the Texas Commission on Environmental Quality (TCEQ), ordering an immediate halt on all data center permits statewide. The pause is mandated until the Electric Reliability Council of Texas (ERCOT) completes a comprehensive audit of data center operations and their impact on state resources.
According to a press release from the governor's office, Governor Abbott's order, issued Monday, requires ERCOT, the Public Utility Commission of Texas (PUC), and the Texas Water Development Board (TWDB) to gather crucial information. This includes details on data centers' interconnection processes, projected power and water consumption, cooling technologies, and neighborhood impacts such as noise and traffic. Developers with pending projects must disclose their plans for electricity generation, whether relying on the state grid or generating their own power.
Governor Abbott emphasized that no other state agency should proceed with regulatory approvals for data centers until this information is acquired. The TCEQ is ordered to provide an update on its permitting decisions by October 19. Additionally, Governor Abbott stated that the next legislative session would focus on eliminating financial incentives for data centers, underscoring a broader state effort to scrutinize the industry's growth.
