Senate Passes Bill Aimed at Snuffing Impact of AI on Ratepayers

The New Jersey Senate Environment and Energy Committee passed a bill that would require all electricity for certain AI data centers and cryptocurrency mining facilities in the state to be derived from new renewable or nuclear energy sources, with the goal of minimizing the impact on ratepayers. The bill would require BPU approval of energy usage plans for these facilities and monitoring of similar requirements in other states in the PJM region.

The New Jersey Senate Environment and Energy Committee passed a bill that would impose new energy requirements on AI data centers and cryptocurrency mining facilities in the state. The bill would require all electricity for these facilities to be derived from new verifiable Class I renewable energy, energy from newly constructed nuclear power plants, or a combination thereof, such that there is no net decrease in renewable and nuclear energy supplied to the transmission and distribution system.
The bill aims to provide "rate relief" for ratepayers by requiring these energy-intensive facilities to bring their own new renewable or nuclear energy sources rather than drawing from the existing grid. The committee chairman, Senator Bob Smith, said the bill is "not saying 'don't come here,' just pay for your own increase."
The bill would require facilities to submit energy usage plans to the New Jersey Board of Public Utilities (BPU) for approval, detailing how they will meet the energy requirements as well as measures to optimize energy and water usage. The BPU would have 90 days to approve, conditionally approve, or reject the plans.
The bill also directs the BPU to monitor similar requirements in other states in the PJM regional transmission organization, and to impose the New Jersey requirements if a majority of PJM states adopt them.
