North Dakota has developed a comprehensive model ordinance to guide local governments in evaluating data center proposals. Created by a coalition of government and industry groups, the ordinance provides tools to address concerns such as electricity demand, water usage, and environmental impacts. This framework aims to ensure transparency and local input in data center development decisions across the state.
Terry Effertz, executive director of TechND, a North Dakota technology trade association, highlighted North Dakota's proactive strategy for integrating data centers into its economy. He emphasized the importance of transparency, genuine local input, and a skeptical approach to proposals that may not serve communities.
Instead of dismissing concerns about data centers' significant electricity and water consumption, as well as their local environmental effects, a broad coalition was formed. This group included the North Dakota League of Cities, the North Dakota Association of Counties, planning and zoning experts, data center industry representatives, and TechND. Over several months, they collaborated to study best practices from other states and identify community needs.
This collaborative effort resulted in a comprehensive model ordinance designed to provide local governments with effective tools for thoroughly and fairly evaluating data center proposals. The ordinance addresses critical issues such as electricity demand and grid impacts, water usage and recycling, environmental effects, noise standards, and emergency response protocols. It aims to empower communities to make informed decisions based on their specific values and circumstances, balancing economic benefits with local concerns and protecting property rights.
