Raleigh City Council adopted a six-month moratorium on data center applications and permitting, but a court ruling in neighboring Chatham County could force the city to allow a proposed 100,000-square-foot Radius DC facility. The council is scheduled to discuss the ruling and its implications for the project during upcoming work sessions.

Raleigh City Council approved a six-month moratorium on new data center applications and permits, but the pause may not apply to a proposed 100,000-square-foot facility on Jones Sausage Road. Radius DC had previously been told it could build on the site if the property is annexed into southeast Raleigh, and the company says it intends to continue pursuing the project.

The issue gained urgency after a Chatham County judge ruled that developers with Eco TIP West could proceed despite that county’s 12-month moratorium. The developers argued that the moratorium violated state law protecting projects that had already incurred substantial expenditures or received prior development approvals. Raleigh officials are expected to consider the ruling and its effect on the Radius DC proposal during two scheduled work sessions.
