Attorney General Ken Paxton has initiated a "landmark investigation" targeting hundreds of data center developments across Texas. The probe seeks to compel these facilities to comply with state laws requiring them to report water usage to the Texas Water Development Board (TWDB). According to Paxton's office, numerous data centers have failed to respond to the TWDB's water use surveys, a mandate for entities utilizing groundwater and surface water for industrial purposes.
The Attorney General's office (OAG) will oversee the investigation to ensure all data centers submit accurate and up-to-date water usage information. Paxton stressed the importance of transparency and legal compliance, stating his commitment to protecting Texas communities and water resources, and preventing the depletion of the state's natural assets and energy supply. The investigation is ongoing in multiple counties, including Harris, Montgomery, Travis, Dallas, Tarrant, Smith, Bexar, Tom Green, Potter, Randall, Lubbock, Midland, Ector, Wichita, Victoria, Brazos, Nueces, and El Paso, underscoring the statewide scope of the legal action.
