These data centers are being probed for their alleged failure to respond to mandated water use surveys conducted by the Texas Water Development Board. The investigation aims to ensure transparency in water usage and compliance with state law.
Texas Attorney General Ken Paxton announced a statewide investigation into hundreds of data center developments for failing to comply with state law regarding water use reporting. The probe targets data centers that have not responded to surveys issued by the Texas Water Development Board, which is legally required to collect water usage data from industrial, municipal, power generation, and mining entities.
Attorney General Paxton stated that his office is committed to ensuring transparency in water usage and full compliance with the law, emphasizing the responsibility to steward the state's resources. He highlighted concerns about sacrificing Texas's water and energy supply, vowing to continue fighting for communities across the state. Data centers under initial investigation are located in numerous counties, including Harris, Montgomery, Travis, Dallas, Tarrant, Smith, Bexar, Tom Green, Potter, Randall, Lubbock, Midland, Ector, Wichita, Victoria, Brazos, Nueces, and El Paso. The Attorney General's office intends to continue the investigation until all data centers meet state reporting requirements.
