
Pa. Senate committee advances bill to prohibit NDAs in data center development
The Pennsylvania Senate Communications and Technology Committee unanimously advanced Senate Bill 1408, sponsored by Sen. Tracy Pennycuick, to prohibit data center developers from using non-disclosure agreements with state agencies and local governments. The bill will move to the full Senate for consideration and is intended to increase public transparency around proposed data center projects.
The Pennsylvania Senate Communications and Technology Committee unanimously approved Senate Bill 1408 on Sept. 29. Sponsored by Sen. Tracy Pennycuick, the measure would bar data center developers from entering into non-disclosure agreements with Pennsylvania state agencies and local governments, and will advance to a vote before the full Senate.
Pennycuick said NDAs can prevent residents from learning about proposed projects and participating in decisions affecting their communities. The bill is part of a broader legislative package addressing local concerns about the rapid growth of large data center developments.
