Companies sue Nye County over data center development ban
Two companies, CDDC, LLC and 9 of a Kind, LLC, are suing Nye County, Nevada, over its recent ban on data center development in the Pahrump area. They argue the ban violates their property rights and disregards substantial investments made toward their proposed Manse Technology Center project based on existing zoning laws.
CDDC, LLC and 9 of a Kind, LLC have filed a lawsuit against Nye County, Nevada, challenging the county's recent ban on data center development in the Pahrump area and Water Basin 162. The companies, which own nearly 911 acres along Carpenter Canyon Road and Nevada State Route 160, have sought for years to build the Manse Technology Center, also known as the MTC Project.
Their attorneys contend that the Pahrump Regional Planning District had essentially approved the plan, leading to significant investments by the companies. However, last month, the Nye County Board of Commissioners voted to enact Ordinance No. 631, banning data centers in the specified areas. The companies argue this abrupt change violates their State property rights and common law property rights, deeming the zoning designation vague and subject to arbitrary enforcement. Sean Dalesandro, developer of the Manse Technology Campus, stated that the project complied with existing zoning laws and received consistent positive guidance from Nye County, making the retroactive rule change unjust.
