The Palm Beach County Board of County Commissioners voted 5-1 to deny Project Tango, a controversial AI data center, after a lengthy debate on Wednesday. The decision, which reflects the increasing challenges local governments face in regulating rapidly expanding tech infrastructure, came despite a last-ditch effort by developers to revise plans and address community concerns.

Palm Beach County Mayor Sara Baxter recused herself due to prior public statements opposing the project, while Commissioner Maria G. Marino was the sole vote in favor, stating, "I would say we need this." Commissioners expressed reservations, highlighting confusion over the project's zoning status. Attorney Brian Seymour, representing the applicant, argued the request was for an "allocation of permitted uses" already allowed under county code, aiming to replace heavier industrial operations. However, county staff clarified that the application sought to add approximately 1.5 million square feet to the master plan, making it a new request.

Opposition centered on the project's scale and proximity to residential areas and Saddle View Elementary School, as well as significant concerns regarding water consumption and low-frequency noise. Opponents had also filed an emergency legal request to block the commission's vote, which was denied by a Palm Beach County judge just prior to the meeting.

The denial was issued "without prejudice," allowing developers to address the board's concerns and potentially resubmit a modified proposal. However, the future of Project Tango remains uncertain as Palm Beach County is actively re-evaluating its definitions and regulations for "AI hyperscale" projects.
