Governor Abbott Announces PUC And ERCOT Actions Protecting Residential Ratepayers From Data Center Costs
Governor Greg Abbott has announced that the Public Utility Commission of Texas (PUCT) and the Electric Reliability Council of Texas (ERCOT) are taking concrete steps to protect residential ratepayers from data center expansion costs. These actions aim to ensure data centers cover their own electric infrastructure needs and prevent increased utility bills for Texans. Additionally, legislative changes are being recommended to codify these protections.
Governor Greg Abbott has announced that the Public Utility Commission of Texas (PUCT) and the Electric Reliability Council of Texas (ERCOT) are actively implementing his June 10 directive to shield residential ratepayers from the financial burdens of data center expansion. Governor Abbott stated that these actions are crucial to keeping electric bills affordable and safeguarding the state's water resources, emphasizing that residential consumers should not subsidize the industry's growth.
The directive specifically tasked the PUCT with ensuring data centers bear the costs of necessary electric infrastructure, verifying that their connection actually reduces residential bills, and collaborating with ERCOT on further ratepayer protections. In response, PUCT and ERCOT have initiated several key measures. The PUCT plans to adopt a new rule by the fourth quarter of 2024, designed to protect ratepayers from data center costs by ensuring these facilities are responsible for their grid impacts. ERCOT is concurrently reviewing its interconnection process for large loads like data centers and implementing market rule changes to enhance grid visibility and planning.
Looking ahead, both commissions have recommended legislative changes for the upcoming session. These proposals include establishing a state policy that requires data center developers to cover their grid infrastructure costs and prohibiting the socialization of these expenses among existing ratepayers. Governor Abbott has pledged to work with the Legislature to enact these protections, reinforcing his commitment to prevent data center development from negatively impacting Texas ratepayers.
