A legal battle regarding the PAX-1 data center project has entered a Cumberland County, Pennsylvania courtroom, where neighbors are actively seeking to halt its development. Opponents, including resident Andrew Dembski, argue that the data center overlay zoning, which applies to a nearly 700-acre area, was illegally placed on a site designated for residential housing.
Attorneys representing the project's opponents are asking the courts to intervene and pause development while their various legal challenges, including one against the zoning overlay approved last year, are heard. They contend that any actions taken by the township since the zoning approval should be deemed invalid due to the alleged substantive validity challenge that should have preceded the Zoning Hearing Board's decision.
Legal representatives for the PAX-1 project did not comment to reporters after the hearing. However, they argued in court that all legally required procedures have been followed and that development of the project should be allowed to proceed as planned.
