A lawsuit filed against the city of Bessemer concerning a zoning decision for a proposed data center, identified as Project Marvel, has been dismissed. A court announced this week that both the city and the three local residents who initiated the legal action agreed to the dismissal.

The case, originally filed in April of the previous year, aimed to secure a restraining order to prevent the city from rezoning the area designated for the 18-building data center campus. The plaintiffs contended that Bessemer had not provided adequate notice regarding the rezoning process. The Project Marvel data center is anticipated to take several years to complete.
