The Department of Justice (DOJ) is attempting to quash a lawsuit filed by the NAACP and various environmental groups against a power plant that provides power to Elon Musk's xAI data center. The lawsuit specifically targets a power plant located in Southaven, Mississippi, alleging that it operates 57 turbines without the necessary permits and in violation of the Clean Air Act. Plaintiffs claim the plant is a major source of smog-forming nitrogen oxide and other harmful air pollutants, which disproportionately affect vulnerable communities, and they are seeking substantial daily penalties and an injunction to stop the turbines.

xAI has asserted that the turbines are temporary and therefore exempt from stricter permitting requirements. On Monday, the DOJ, through Associate Attorney General Stanley Woodward Jr., intervened, arguing that allowing the lawsuit to proceed would threaten national security. The department stated that shutting off the power supply would jeopardize "artificial-intelligence innovation that supports the Department of War's military operations," and contended that the executive branch holds unchallenged authority to halt such private environmental lawsuits.

Environmental groups, including Earthjustice and the Southern Environmental Law Center, have strongly criticized the DOJ's intervention, calling it a "massive power grab" and unprecedented for the government to side with a polluter against environmental laws. Abre' Conner, NAACP director of Environmental and Climate Justice, emphasized the importance of the Clean Air Act in holding polluters accountable. Cameron Stanley, the Defense Department's AI official, further supported the DOJ's stance by highlighting that a version of xAI's Grok AI is utilized in automated targeting for military operations, reinforcing the national security implications of the power plant's continued operation.
