DOJ Files Appeal in Effort to Join NAACP xAI Data Center Suit
The Justice Department has filed an appeal with the US Court of Appeals for the Fifth Circuit, seeking to intervene in an air pollution lawsuit. This suit was originally brought by the NAACP against Elon Musk's xAI data center project. The DOJ claims the district court's delay in ruling on its motion to intervene amounted to an effective denial.
The Justice Department (DOJ) has formally appealed to the US Court of Appeals for the Fifth Circuit to gain intervention in a significant air pollution lawsuit. This legal challenge was initially launched by the NAACP against Elon Musk's xAI data center project. The DOJ submitted its notice of appeal on September 18.
The department contends that the US District Court for the Northern District of Mississippi's prolonged delay in ruling on its previous motion to intervene should be considered an "effective denial," thereby making it eligible for appeal. During an August 24 status conference, the district court reportedly signaled its intention to deny the DOJ's motion.
The lawsuit centers on environmental concerns related to the xAI data center's air emissions. The DOJ's involvement underscores the federal government's interest in the case, adding another layer to the ongoing legal battle.
