Cave City data center lawsuits to move forward together
Two lawsuits related to a proposed data center in Cave City, Kentucky, are expected to be combined by a Barren Circuit Court judge. The lawsuits involve the Kentucky Industrial Alliance challenging a 12-month moratorium on data center development enacted by Cave City and a dispute over property annexation, including Shaw Cemetery. The Alliance argues the city failed to follow proper procedures for the moratorium and seeks an injunction to allow its development plan to proceed.
Two lawsuits concerning a proposed data center development in Cave City, Kentucky, are slated for combination by Barren Circuit Judge John T. Alexander. The cases, 26-CI-00445 and 26-CI-00500, were discussed in a Monday motion hearing in Barren Circuit Court.
The first lawsuit, filed by the Kentucky Industrial Alliance (KIA), challenges Cave City's 12-month moratorium on data center development. KIA contends that the city did not adhere to required planning, notice, and public hearing procedures when adopting the moratorium. The Alliance also asserts that it submitted a development plan prior to the moratorium's effective date and is seeking an injunction to prevent its enforcement, requesting its plan be reviewed under prior zoning regulations. Cave City, in turn, has moved to dismiss this case.
The second lawsuit, 26-CI-00500, pertains to the annexation of property for the proposed development and includes a dispute involving Shaw Cemetery. No motions were pending for this case during the recent proceedings.
Judge Alexander is anticipated to issue an order to combine the two cases to streamline the litigation process. A status conference for the combined cases is scheduled for November 23.
