Company behind data center near Nashville Zoo sues Metro Nashville
DC BLOX is suing Metro Nashville government, claiming the city is illegally blocking a data center project near the Nashville Zoo that had already received zoning approval. Metro Nashville passed a moratorium in July, and DC BLOX alleges it is being unfairly applied to their vested project, despite internal legal advice to the contrary, suggesting the action was specifically targeted at them.
DC BLOX has filed a lawsuit against the Metro Nashville government, alleging that city leaders are illegally obstructing a data center project that had previously received official approval. The company asserts that it invested $23 million in property near the Nashville Zoo for the data center, obtaining necessary permits before new city ordinances were enacted.
The lawsuit states that Metro Nashville passed a moratorium on data center permitting in July and is applying it to the DC BLOX project, despite the company's claim of vested rights and Metro's own legal team reportedly advising against such application. DC BLOX suggests this is not a neutral pause, citing a council member's public statements about legislatively preventing the project, indicating targeted opposition. Metro has also initiated condemnation proceedings for the property.
In response, Metro Law Director Tyler Yarro stated that Metro Legal is reviewing the lawsuit and is confident in the lawfulness of Metro's actions regarding DC BLOX and the moratorium's enactment. No hearing date has been set for the lawsuit.
