The NAACP has initiated legal action against Elon Musk's xAI and its subsidiary MZX Tech, accusing them of violating the Clean Air Act by operating dozens of natural gas turbines at the Colossus 2 data center in Southaven, Mississippi, without a required federal air permit. The lawsuit, filed in federal court in Mississippi, alleges that 27 turbines have been operating since 2025 at the Colossus Gas Plant, emitting smog-forming pollution, fine particulate matter, and formaldehyde, which the group associates with serious health issues. Abre' Conner of the NAACP stated, "A data center should not be a potential death sentence for a community's health," highlighting that a disproportionately Black population resides near the data hub. The NAACP, represented by the Southern Environmental Law Center and Earthjustice, is seeking a court order to shut down the plant until proper permits are secured, install pollution controls, and impose daily civil penalties. Additionally, the organization has requested Mississippi regulators to revoke a recently issued permit for a larger, 41-turbine permanent plant linked to xAI's expanding data operations in the Memphis area. xAI has countered these claims, asserting that the turbines are temporary and do not require a federal permit, stating that "the temporary power generation units are operating in compliance with all applicable laws."
