Commerce city planners have unanimously voted to recommend approval of a package of amendments to the city's Unified Development Code (UDC), which includes new regulations specifically targeting data centers. The proposed changes, which closely mirror existing regulations in Jackson County, would significantly restrict the construction and location of data centers within Commerce. Previously, data centers were permitted in almost all zoning districts in Commerce. Under the new UDC amendments, data centers would only be allowed in M-2 (heavy industrial) zoning districts and would require a conditional use/special use permit. Planning and Development Superintendent Dillon Anthony presented the proposed standards to the commission. Key provisions of the new regulations include a minimum site size of 10 acres, a perimeter fence of at least eight feet, and a separation requirement of at least 1,000 feet from existing residences and 500 feet from residentially or agriculturally zoned properties. The standards also impose noise limits, mandate stormwater and utility impact studies, require emergency response plans coordinated with local fire services, and grant the city authority to inspect facilities and levy penalties for violations. The amendments will now proceed to the Commerce City Council for final consideration and action.
