Texas lawmakers are questioning new Electric Reliability Commission of Texas (ERCOT) rules designed to manage data center growth on the state's power grid. Texas lawmakers and industry representatives are raising concerns that new stringent rules from the Electric Reliability Commission of Texas (ERCOT) for connecting large projects to the state's power grid could deter industrial development. The rules, approved by the Public Utility Commission of Texas (PUC) in June, require large projects, including data centers, industrial facilities, and hydrogen production, to be evaluated in batches rather than individually. This process, known as the batch study, was developed over the past year in response to Texas' data center boom and its record-breaking demand on the electric grid.

During a July 29 legislative hearing, industry experts, including Warren Lasher representing industrial trade associations, warned state senators that the batch process, with its rigid requirements and hefty financial commitments of $50,000 per megawatt, may not be suitable for traditional industrial projects. These projects often have inflexible timelines and specific location needs, making it difficult for them to compete with data centers under the new framework. ERCOT CEO Pablo Vegas explained the process will identify gaps in transmission capacity and highlight necessary upgrades.

Senators, including Phil King (R-Weatherford) and José Menéndez (D-San Antonio), expressed concerns about the state's ability to attract major companies like SpaceX or Toyota if industrial projects face lengthy delays or are excluded. PUC Chair Thomas Gleeson acknowledged the process might not work for all large loads and indicated that a 'bifurcated process' for data centers and other industrial projects is being discussed. Sen. King urged the PUC to issue a public statement to allay fears among industrial developers.

Clift Pompee, Vice President of Power and Emissions for Compass Datacenters, shared his company's experience, stating they spent millions preparing for the batch process and paid $6.5 million in financial commitments. Despite this, their planned data center project was initially excluded from Batch Zero due to a utility provider's failure to complete a required transmission study. Pompee criticized the process for giving 'ghost and phantom loads' allocation while legitimate projects are left out, urging lawmakers to mandate binding deadlines for transmission providers. Sen. King also voiced concern about potential lawsuits once Batch Zero results are released in early August.
