Judge rules Oxmoor Valley neighbors’ lawsuit against Nebius data center can proceed
A Jefferson County judge ruled that a lawsuit filed by Oxmoor Valley residents against the Nebius AI data center under construction in Birmingham can proceed. The Greater Birmingham Humane Society has also joined the growing list of organizations and neighbors suing the data center. A preliminary hearing is scheduled for Tuesday.
A Jefferson County judge ruled on Friday that a lawsuit filed by residents of Oxmoor Valley against the Nebius AI data center, currently under construction off Lakeshore Parkway in Birmingham, Alabama, can move forward.
The Greater Birmingham Humane Society has also announced its participation, joining the expanding group of organizations and neighbors taking legal action against the data center developer. The plaintiffs are challenging the development of the AI data center.
