Additionally, B.E.A.R. is engaged in two separate lawsuits. One was filed on June 3 in Utah
First District Court, seeking to overturn the county's denial of their application to place the data center project on the November ballot. The second lawsuit, filed recently in Third District Court by the Alliance for a Better Utah and five B.E.A.R. members, targets Box Elder commissioners and the Military Installation Development Authority. This litigation alleges that officials violated residents' constitutional rights by approving the Stratos Project Area Plan without allowing residents to voice their concerns on a matter potentially impacting their environment, health, and livelihood.
