Arizona attorney general threatens lawsuit over south Phoenix data center
Arizona Attorney General Kris Mayes threatened possible legal action against MenLo Digital over its AI data center under construction in Ahwatukee, citing noise, dust, water use and energy concerns. Residents are opposing the project, while Phoenix officials investigate complaints and Mayes continues examining whether nuisance laws could apply.
Arizona Attorney General Kris Mayes said her office is investigating MenLo Digital's AI hyperscale data center under construction in Ahwatukee, a south Phoenix neighborhood. At a town hall in Mesa attended by about 150 residents, community members described late-night construction noise, dust and disruptions, while Mayes warned that data center growth could increase pressure on Arizona's water supplies and electricity costs.
Mayes previously called for a moratorium on new data center approvals, although she acknowledged that only the Legislature and governor could impose one. Phoenix has stationed inspectors at the project and negotiated measures to reduce construction impacts, including restrictions on deliveries and traffic and additional noise monitoring. MenLo Digital did not respond to a request for comment, and Mayes said she had not yet determined what legal action, if any, she would take.
