Data center developer takes Plains Twp. to court over zoning denial
Mudiita Land Holdings sued Plains Township after commissioners voted 4-0 to reject a proposed zoning overlay that would have allowed a data center campus on roughly 592 acres. The lawsuit seeks a curative amendment, while the township says it will hold a hearing and consider whether its existing ordinance needs to be amended.
Mudiita Land Holdings filed a lawsuit against Plains Township after the township’s Board of Commissioners rejected a proposed energy and technology zoning district for about 592 acres near the Pennsylvania Turnpike. The developer intends to build a data center campus and argues that the township’s decision lacked a consistent land-use rationale.
Hundreds of residents attended the commissioners’ meeting, and the 4-0 vote rejecting the overlay drew cheers from the audience. Plains Township has retained attorney Jeffrey Malak, who said the township will hold a hearing to assess the validity of its existing ordinance and whether a curative amendment is necessary.
