Attorneys for Sabey Data Centers have filed a motion to dismiss a legal challenge initiated by residents of Decatur Township in Indianapolis, Indiana. The lawsuit, filed by attorney Arie J. Lipinski on behalf of seven residents, seeks to reverse property zoning changes approved in March that would allow Sabey to build a 1-million-square-foot data center on the southwest side of Marion County. Residents claim the project will negatively impact their health, quality of life, and property values, and that the Metropolitan Development Commission, Sabey, and the owners of Decatur Technology Park violated zoning rules.

Sabey's attorneys filed the motion to dismiss on June 15, arguing that the citizens' petition fails to comply with statutory requirements for judicial review. A status conference for both sides is scheduled for June 29 to discuss the ongoing legal proceedings. Additionally, "Protect Decatur Township," a local advocacy group opposing the data center, is organizing fundraising events to support their legal efforts.
