Milford Town Attorney Updates Council on Data Center Zoning Limitations
The Town of Milford attorney informed the Town Council that they cannot unilaterally ban data centers as they lack their own plan commission; the county would need to pass an ordinance. Currently, the county's zoning requires exceptional use approval for data centers, not an automatic ban. The attorney also advised that the town cannot pass a moratorium on data centers.
At a recent meeting, Milford Town Attorney Jay Rigdon informed the Milford Town Council about several matters, including the town's ability to regulate data center development. Rigdon stated that the Town of Milford cannot unilaterally ban data centers because it lacks its own plan commission. For such a ban, the county would need to pass an ordinance.
Rigdon explained that under the current county zoning ordinance, data centers would require an 'exceptional use' approval rather than being automatically banned. Councilman Ken Long inquired if the town could implement a moratorium, but Rigdon clarified that this was not possible without county action. Consequently, the town's authority on zoning issues related to data centers is dependent on the county's decisions.
