The Village of Commercial Point Council passed an 18-month moratorium on data center development by a 5-1 vote at its recent meeting. This decision came after significant public debate and concerns regarding the impact of industrial-scale data centers on the community.
Council members Ezekiel Miller and Patricia Anderson expressed support for the moratorium, viewing it as a crucial first step for community organizing and planning. However, Bill Scala urged the Council to table the moratorium, noting that AWS had withdrawn from the second phase of a data center project intended by K-NOVA. Bruce Moore, attorney for K-NOVA, stated that his client had attempted to compromise with the Village.
Residents, including Sue and Bob Harmacek, Justin Baldwin, and Taise Young, voiced strong opposition to data centers being built near residential areas, citing concerns over health, welfare, economic stability, noise, lights, property values, and public safety. Young specifically highlighted the "zoning sacrifice" in the Foxfire development. Spencer Dirrig, from the Ohio Environmental Council (OEC) Action Fund, also supported the moratorium, advocating for local communities' right to make informed decisions about data centers with full transparency and proper impact analysis.
Rickey Baldwin cautioned the Council about potential legal actions that could financially jeopardize the village. The enacted Ordinance 2026-09, establishing the moratorium, is intended to allow the Village of Commercial Point time to address these concerns and plan for future development.
