Lincoln County commissioners unanimously approved new regulations requiring all future data center projects to undergo public hearings and obtain a Conditional Use Permit, rather than being a permitted use. This marks the first major policy change stemming from months of discussion, designed to ensure public review and allow for project-specific conditions despite no current proposals. The decision follows a recent rejection of a temporary moratorium on data center development.
Lincoln County commissioners have unanimously approved new regulations for future data center projects, mandating that all proposals now require a Conditional Use Permit (CUP) and must undergo public hearings. This significant shift means data centers will no longer be considered a permitted use in industrial districts, a change from the previous administrative approval process.
The policy modification, which represents the first major regulatory change following months of county-wide discussions, aims to provide enhanced public review and allow officials to implement project-specific conditions. Planning Administrator Judy Clark confirmed the CUP process includes safeguards for potential project alterations. This action comes after commissioners recently voted down a proposed temporary moratorium on new data center development, opting instead to refine existing county regulations.
Commission Chairman Kent Weems stated that these regulations are considered a "living document," subject to further evolution as the county gains more experience with the data center industry. Public comments leading up to the vote reflected a divided community, with some residents supporting the balanced approach for economic development and landowner protection, while others advocated for continued refinement of the language. Commissioners clarified that the vote was not an approval of any specific data center project, but rather a mechanism to establish a comprehensive review process for future applications.
