Judge denies request for temporary restraining order on Springfield data center moratorium
A Greene County judge denied a temporary restraining order sought by developer Trent Overhue in a lawsuit challenging Springfield’s moratorium on data center applications. Springfield’s moratorium remains in effect, while the City Council is scheduled to consider extending it and advancing data center regulations.
Greene County Circuit Court Judge Nathan Taylor denied developer Trent Overhue’s request for a temporary restraining order in the first court action involving a lawsuit against Springfield’s data center application moratorium. Overhue filed the suit through NSI, A.1 LLC, which owns property at 2900 S. National Ave. where he has proposed a data center.
The Springfield City Council adopted a 120-day moratorium in June to allow city staff to gather public input and develop a regulatory framework. The council is scheduled to hold a public hearing on extending the moratorium for another 120 days, potentially through Feb. 24, 2027, while also considering data center definitions and a separate utility-related moratorium. The Planning and Zoning Commission is expected to review draft regulations in December before potential council action in January 2027.
