Judge hears Overhue suit over Springfield data moratorium
A Greene County judge heard arguments in NSI A.1 LLC's lawsuit challenging Springfield's 120-day moratorium on data center applications. The judge took the developer's request for a preliminary injunction under advisement, while the Springfield City Council is expected to vote on extending the moratorium.
Greene County Circuit Court Judge Nathan Taylor heard arguments in NSI A.1 LLC's lawsuit against the city of Springfield over its 120-day pause on accepting and processing data center applications. The company, affiliated with developer Trent Overhue, is seeking a preliminary injunction but did not receive an immediate ruling.
NSI A.1 LLC submitted a pre-development application for a small high-performance computing and data processing facility at 2900 S. National Ave., along with offices for a management company overseeing other facilities. Springfield adopted the moratorium on June 29 to create a regulatory framework for data center development, and the City Council is expected to vote on Nov. 16 on extending the pause for another 120 days.
