The Association of County Commissions of Alabama (ACCA), representing all 67 counties, has issued a call for a broader discussion on zoning and land use policy in Alabama. This comes as communities across the state are experiencing increasing pushback against data center developments, driven by concerns over electricity costs and significant land usage. Several cities have begun updating their zoning restrictions, and some counties have enacted moratoriums to address the rapid influx of data center projects.
Sonny Brasfield, a representative of the ACCA, explained that the majority of Alabama's counties (over 60 out of 67) currently lack the legal authority to regulate development in unincorporated areas. He emphasized that county governments are only empowered to carry out responsibilities specifically granted to them by the state legislature. The ACCA passed a resolution opposing special zoning powers tailored to a single industry, arguing that such specific authority could lead to constitutional challenges, referencing past debates over industries like rock quarries and solar farms.
The statewide discussion also drew national attention, with Vice President JD Vance commenting on the data center backlash before traveling to Michigan. Vance suggested that most of the opposition stems from concerns about data centers increasing utility and electricity costs for local residents. He posited that data centers should ideally contribute power back to the grid rather than solely consuming it, addressing a key point of contention in affected communities.
