A lawsuit has been filed in Marion County, Indiana, by a neighborhood organization and several property owners against the Indianapolis Metropolitan Development Commission, the City-County Council, Sabey Data Center Properties LLC, SCP Decatur Technology Park LLC, and Strategic Capital Partners LLC. The suit aims to reverse the March 18 decision by the Metropolitan Development Commission that approved a $4 billion data center project in Decatur Township, Indianapolis, despite strong community opposition.
The petitioners, represented by attorney Arie Lipinski, allege that the approval of variances and commitment modifications for the proposed Sabey Data Center Technology Park violated their due process rights and Indiana law. They also argue that the 1 million-square-foot data center, planned for a campus along Kentucky Avenue and Camby Road, conflicts with the area's city-approved planned use, which designates it for a mix of retail, offices, and residential developments. The lawsuit also brings forth previously raised concerns about health and safety related to the project.
Sabey Data Centers plans to begin site preparation this year, with the first building projected for completion by 2028 and the second by 2030. Summons have been issued to the defendants, who have approximately two weeks to respond; no hearings have been scheduled as of the last update.
