The Federal Energy Regulatory Commission (FERC) has filed a protest against a proposed 18-mile natural gas pipeline in Doña Ana County, New Mexico, which is slated to power Project Jupiter, a data center complex by Oracle and OpenAI. The federal agency's objection stems from a missing finding regarding the impact on historic properties, requiring Transwestern Pipeline Co., owned by Energy Transfer, to address these issues within 30 days or face a more rigorous project-specific certificate review.
This regulatory challenge follows an earlier setback in March, when the New Mexico State Land Office denied permits for the $60 million pipeline to cross state trust land. State Land Commissioner Stephanie Garcia Richard determined that allowing the pipeline was not in the best interest of the trust. Oracle has stated its commitment to meeting all regulatory requirements for Project Jupiter, emphasizing the anticipated economic benefits for the community.
Michelle Ensey, New Mexico’s historic preservation officer, confirmed her division is reviewing the request for comments. Jon Copeland, an organizer with Hold the Line Campaign, highlighted the rarity of a FERC staff protest and called for public scoping meetings and a full environmental analysis in Doña Ana County to ensure protection of cultural artifacts and natural resources.
