New Mexico Supreme Court lets permitting process continue for Project Jupiter
The New Mexico Supreme Court has ruled in favor of Project Jupiter, allowing its permitting process for a data center in Doña Ana County to continue. This decision unfreezes a key part of the process that had been paused due to environmental challenges regarding water use and air quality permits.
The New Mexico Supreme Court has sided with Project Jupiter, unfreezing a critical part of the permitting process for a data center under construction in Doña Ana County. The court had previously paused the process in August following two separate environmental challenges.
The Center for Biological Diversity contested the emergency authorization for water from a new well, arguing that its use did not constitute an emergency under state law and required a public hearing. Concurrently, New Energy Economy challenged the pending air quality permit, asserting they were denied crucial discovery before a scheduled hearing.
In its recent orders, the Supreme Court denied both petitions, resulting in favorable rulings for Project Jupiter in both cases and allowing the development's permitting to proceed.
