Attorneys reach partial agreement on some records in Birmingham data center lawsuit
Homeowners challenging the proposed Nebs AI data center in Birmingham's Oxmoor Valley sought records related to land transactions, including documents from Iron City Premier Realty, which is connected to Mayor Randall Woodfin's wife. A court hearing ended with a partial agreement requiring defendants to provide executed settlement documents and purchase agreements, while the case remains scheduled for trial in March.
Attorneys for Robert and Gayle Sansom, who are challenging the proposed Nebs AI data center in Birmingham's Oxmoor Valley, appeared in court over subpoenas seeking records tied to land transactions associated with the project. The homeowners said transactions ranging from $12.7 million to $83.5 million raised questions they believed warranted further investigation.
Iron City Premier Realty, a company connected to Mayor Randall Woodfin's wife, opposed one subpoena, saying it had no role in acquiring, financing, brokering, developing or closing the property and calling the request a fishing expedition. The City of Birmingham and other entities also challenged portions of the subpoenas. After the judge asked the parties to reach an agreement, defendants agreed to provide executed settlement documents and purchase agreements related to the land. The case is scheduled for trial in March, and the homeowners may seek additional records after reviewing the documents.
