Maryland Governor Signs Executive Order Regulating Data Centers

Maryland Governor Wes Moore signed an executive order establishing new standards and a single review process for large data center proposals across the state. The order mandates that future data center projects align with five new principles focused on increasing accountability and transparency, particularly regarding state-issued permits and incentives. It emphasizes local hiring, preventing strain on the electric grid, and granting local residents more influence in the development process.

Governor Moore also called on state lawmakers to repeal a 2020 law that provided sales and use tax exemptions for data centers, a measure previously sponsored by his Republican opponent, former Del. Dan Cox. The executive order stops short of implementing a statewide moratorium, though Moore had previously indicated he would sign one if passed by the legislature. A new task force will be created with the authority to review all projects and maintain an online dashboard detailing proposed plans, including expected electricity and water usage.
