The county will seek a legal opinion before formally proposing the change to ensure regulatory control over the industry.
Leaders in Loudoun County, Virginia, are exploring a plan to revoke an exemption that currently allows 22 in-progress data center projects to bypass public hearings. The Loudoun County Board of Supervisors held a seven-hour meeting, dedicating 90 minutes to public commentary on the initiative, where residents expressed concerns about public trust and unchecked industry growth. Supervisor Juli Briskman stated the community "is begging us to use every tool in our toolbox" to control the industry.
Historically, Loudoun County had "by right" zoning, allowing data centers to be approved without public hearings if they met office building requirements. Last year, these standards changed, making public approvals mandatory for new projects. However, 22 developments already in progress were "grandfathered" under the old rules, exempting them from public scrutiny.
County officials now seek to eliminate these exemptions, which would subject these 22 projects to public feedback and a board vote. The Board decided to obtain a legal opinion before formally introducing a proposal to enact this change.
