A St. Louis County Circuit Court judge scheduled a Dec. 10 summary judgment hearing in a lawsuit seeking to stop CRG Acquisition LLC’s proposed data center in Festus. The lawsuit, filed by Wake Up Jeffco representatives, challenges the city’s rezoning, public-meeting procedures, records disclosures and infrastructure development agreement for the project.

Judge Ellen W. Dunne scheduled a Dec. 10 summary judgment hearing in St. Louis County Circuit Court for litigation over CRG Acquisition LLC’s proposed data center in Festus. CRG, the St. Louis-based data center development arm of Clayco, would develop the property, but an operating data center company has not yet been identified.

The lawsuit was filed by attorney Steve Jeffery on behalf of Wake Up Jeffco after residents began protesting the project. It alleges that Festus unlawfully rezoned seven parcels, violated public-meeting and open-records requirements, failed to provide proper notice and improperly approved an infrastructure development agreement. The court dismissed one claim concerning the city’s handling of more than 300 complaints, while other claims remain scheduled for consideration at the summary judgment hearing.
